For those interested in the theories behind compliance programs and legislation that prescribes compliance, it is interesting to read the paper of Todd Haugh on corporate compliance, titled “The Criminalization of Compliance“, the full text is to be found here.
According to the abstract he argues the compliance programs developed by companies mimic criminal law. The result of these programs is that they are fostering misconduct.
